Please read these Terms of Service ("Terms") carefully before using PaperCalm ("the Service," "we," "us"). By creating an account, checking the agreement box, or using the Service in any way, you ("you," "the User") agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Age and Eligibility

You must be at least 16 years old to use PaperCalm, or the minimum age required in your country to consent to use of an online service, whichever is higher. If you are using the Service on behalf of someone else (for example, helping a family member), you confirm you have their permission to upload their documents.

2. What PaperCalm Is (and Is Not)

PaperCalm is a tool that uses artificial intelligence to read documents you upload and provide a plain-language explanation and a suggested list of steps.

PaperCalm is NOT:

• Legal advice, and does not create a lawyer-client relationship
• Medical advice, and does not diagnose, treat, or provide guidance on any health condition
• Financial, tax, or accounting advice
• A substitute for professional review of any important document

The explanations and steps generated by PaperCalm are AI-generated content. AI systems, including the one powering this Service, can make mistakes, misread documents, omit important details, or produce inaccurate output. You must independently verify any information that matters to you before acting on it.

3. Your Responsibility

By using PaperCalm, you acknowledge and agree that:

• You are solely responsible for any decisions or actions you take, or choose not to take, based on information provided by the Service.
• You will independently verify any deadline, requirement, obligation, or instruction generated by the Service before relying on it, particularly where money, legal rights, health, or important deadlines are involved.
• You will seek advice from a qualified professional (a lawyer, doctor, accountant, or other relevant expert) for any decision of legal, medical, financial, or other significant consequence.
• You are responsible for the accuracy and legality of any document you upload, and for ensuring you have the right to upload and process that document.
• You will not use the Service for any unlawful purpose or to process documents belonging to someone else without their consent.

4. Acceptable Use

You agree not to use PaperCalm to upload content that is illegal, infringes someone else's rights, or that you do not have permission to process. You agree not to attempt to disrupt, overload, reverse-engineer, or gain unauthorised access to the Service or its underlying systems. We may suspend or terminate access for any use that violates these Terms, with notice where reasonably possible.

5. Feedback and Suggestions

If you send us feedback, suggestions, or ideas for improving the Service, you agree that we may use them freely to improve PaperCalm, without any obligation or payment to you. This does not apply to the documents you upload for the purpose of getting an explanation, which are handled solely as described in our Privacy Policy.

6. No Warranty

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to warranties of accuracy, completeness, merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be error-free, uninterrupted, or that any explanation or step generated will be accurate or complete.

7. Limitation of Liability

To the maximum extent permitted by applicable law:

• PaperCalm, its owner(s), and operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of income, loss of data, missed deadlines, financial penalties, or any other harm arising from your use of, or inability to use, the Service.
• Our total liability to you for any claim arising from your use of the Service is limited to the amount you paid us in the twelve (12) months preceding the claim, or AUD $50, whichever is greater.
• Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot lawfully be excluded under applicable consumer protection law (including the Australian Consumer Law, where applicable). Where such laws apply and cannot be excluded, our liability is limited, to the extent permitted, to re-supplying the Service or the cost of having the Service re-supplied.

8. Indemnification

You agree to indemnify and hold harmless PaperCalm and its operators from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your misuse of the Service, your violation of these Terms, or your violation of any law or third-party right.

9. AI-Generated Content Disclosure

In accordance with applicable transparency laws, including the EU AI Act, you are hereby informed that the explanations, summaries, and step-by-step guidance provided through this Service are generated by an artificial intelligence system, not a human reviewer.

10. Third-Party Services

PaperCalm relies on third-party providers to operate, including an AI provider for document processing and a payment provider for subscriptions. Your use of those underlying services, where you interact with them directly (such as entering payment details), may also be subject to their own terms. We are not responsible for the availability or performance of third-party services outside our control.

11. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which explains what information we collect, how documents are processed via our AI provider, and how long information is retained.

12. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you should stop using the Service.

13. General

These Terms constitute the entire agreement between you and PaperCalm regarding use of the Service. If any part of these Terms is found unenforceable, the remaining parts remain in full effect. Our failure to enforce a provision is not a waiver of our right to do so later.

14. Governing Law

These Terms are governed by the laws of Queensland, Australia, without regard to conflict of law principles, except where mandatory local consumer protection laws in the user's own jurisdiction apply and cannot be excluded.
